§ 2.06. Vacancies; forfeiture of office.
(A)
Vacancies. A vacancy in the council shall occur upon the death, resignation, removal from office as authorized by law, or forfeiture of office of a council member. When such vacancy occurs, the remaining council members shall select, by the affirmative vote of not less than three (3) of the remaining members, a person to fill the vacancy until the next regular election following not less than seventy-five (75) days upon the occurrence of the vacancy and until a duly elected successor takes office. At this election the seat shall be filled as provided herein for elections for the balance, if any, of the unexpired term. (See Article VII.) An appointee shall be a qualified elector of the town, a citizen of the United States and have resided within the corporate limits of the town for at least six (6) months prior to the date of his or her appointment.
Whenever two (2) or more vacancies shall occur at the same time, the mayor shall within 14 days call a special election to fill the vacancies. Such election shall be conducted in accordance with the procedures for elections (See Article VII).
In no event shall the council consist of more than two (2) members serving on an appointive basis.
(B)
Forfeiture of office. A council member shall forfeit his or her office is [if] such council member (1) lacks at any time during his or her term of office any qualification for the office prescribed by this Charter or by law, (2) is found by the council to have violated any express prohibition of this Charter, (3) is convicted of a felony or a crime involving moral turpitude, or (4) fails to attend three (3) consecutive regular meetings of the council without being excused by the council.
