Article II. BUILDING CODE |
§ 12-19. Adoption of building codes and land development regulations review fees.
(a)
Adoption of the current Florida Building Code, the current Florida Residential Building Code and the current Florida Existing Building Code. There is hereby adopted for the purpose of establishing rules and regulations for the design, construction, erection, alteration, modification, repair or demolition of buildings or structures, including permits and penalties, the most current versions of the Florida Building Code, the Florida Residential Building Code and the Florida Existing Building Code, and those documents are hereby adopted and incorporated as fully as if set out at length herein. It is the intent of this section that, when the state legislature or the state building commission amends the Florida Building Code, the Florida Residential Building Code or the Florida Existing Building Code, then those amendments shall automatically become effective within the town without further action by the town council.
(b)
Local amendments to Florida Building Code. The Florida Building Code, Building sections 107.6 and 117 are expanded to include the following sections related to floodplain management. Said sections shall be applied in the town as expanded.
(1)
Section 107.6.1 Building permits issued on the basis of an affidavit. Pursuant to the requirements of federal regulation for participation in the National Flood Insurance Program (44 CFR 59 and 60), the authority granted to the building official to issue permits, to rely on inspections, and to accept plans and construction documents on the basis of affidavits and plans submitted pursuant to section 105.14 and section 107.6, shall not extend to the flood load and flood resistance construction requirements of the Florida Building Code.
(2)
Section 117.1 Flood hazard areas. Pursuant to F.S. § 553.73(5), the variance procedures adopted in the local floodplain management ordinance shall apply to requests submitted to the building official for variances to the provisions of section 1612.4 of the Florida Building Code, Building or, as applicable, the provisions of R322 of the Florida Building Code, Residential. This section shall not apply to section 3109 of the Florida Building Code, Building.
(c)
Energy efficiency building code. There is hereby adopted by reference the Florida Model Energy Efficiency Code (including page 1-2A, but omitting page 1-2), published by the state energy office as the energy efficiency building code of the town.
(d)
Land development regulations review fees. Permit fees for the review of plans for proposed development, including new construction, remodels and additions, to determine whether the plans are consistent with the comprehensive plan and the land development regulations, are as follows:
(1)
Minimum fee ..... $ 50.00
(2)
One- and two-family dwellings, apartments and additions: Greater of $0.18 per square foot or $2.00 per $1,000.00 of estimated value or fraction thereof.
(3)
Commercial and industrial: Greater of $0.20 per square foot or $10.00 per $1,000.00 of estimated value or fraction thereof.
(4)
Churches, schools, day care: Greater of $0.20 per square foot or $5.00 per $1,000.00 of estimated value or fraction thereof.
(5)
Accessory buildings: Greater of $0.18 per square foot or $1,000.00 of estimated value or fraction thereof.
(6)
Demolition: Greater of $50.00 or $5.00 for each $1,000.00 of estimated value or fraction thereof.
(7)
Swimming pool and/or marcite (commercial) ..... 100.00
(8)
Swimming pool and/or marcite (residential) ..... 70.00
(9)
Garages, carports, decks, residing and porch additions (residential): Greater of $0.18 per square foot or $2.00 per $1,000.00 of estimated value or fraction thereof.
(10)
Garages, carports, decks, residing and porch additions (commercial): Greater of $0.20 per square foot or $5.00 per $1,000.00 of estimated value or fraction thereof.
(11)
Reroofing: Greater of $105.00 or $5.00 for each $1,000.00 or estimated value or fraction thereof.
(12)
Temporary or portable amusement device (per unit) ..... 50.00
(13)
Radio towers and like structures: $50.00 or $5.00 per $1,000.00 of estimated value or fraction thereof.
(14)
Zoning verification (residential) ..... 25.00
(15)
Zoning verification (commercial) ..... 50.00
(16)
Additional inspection due to delay or not being ready ..... 35.00
(17)
Refunds:
a.
No work started: 75 percent of fee.
b.
Work started: 50 percent of fee.
(18)
No fee shall be charged for construction costs less than $100.00, including labor and materials, unless listed in the fee schedule.
(e)
Additional fees. Prior to final inspection and/or issuance of a certificate of occupancy, an applicant shall pay all applicable land development regulations fees set forth in this Code, as well as any additional fees incurred by the town resulting from services rendered by county inspection personnel related to the project(s) at issue.
